Unexplained back pain

My Question is I have had lower back pain for almost a year now, with no sign of inprovement. It started when I woke up one morning with slight pain but it progressively got worse. The area that hurts is the lower right hand side of my body below the ribs and above the buttocks, however it is closer to the buttocks. Also there is swelling in that area as well. I have been to doctors and I have been told many things first my left leg was shorter than my right. Then it was thought to be scoliosis. Then a herinated disc, but I could not get an MRI because I could not lie on my back it would start spasming and my legs were moving uncontrolably. Then I went to theropy for about 3 months with no inprovement. I can bearly walk, and stand even sleeping I have problems I sleep for about an hour then wake up in pain. But I have no known injury and I have been told that a herniated disc would heal over time. It has been about a year and I still have no relivef. My question is what could it possibly be? I thought it might be a kidney infection but my doctor won't test me for it he said that't not it. Any help would be appreciated.
