I have been taking the anti inflammatory drug indomethacin for 40 years and I've simply had to phone my doctor and he's called it in to the pharmacy.Now, all of a sudden he's asking me to make an office appointment and pay him $80 just for writing out a repeat prescription.Is this State Law for a repeat prescription or just an easy way of making money?

It's now getting to be interesting. My doctor has now cited Florida Board of Medicine rule64b8-9.014 which states thatFlorida physicians are prohibited from writing a prescription without performing a documented patient evaluation, including a history and physical examination. He already has the history---40 years of suffering from gout and having to constantly take indomethacin----- and I saw him last as recently as November 2005, when he gave me a prescription for indomethacin. Surely he has therefore complied with tha Act?What's he worried about?

prohibited from writing a NEW prescription - NOT a refill. Tell him to check with his lawyer and you'll check with yours. If he doesn't get it maybe you need a new doctor.

I think he is misinterpreting the law. It states he is prohibited from writing a new prescription without documenting history and physical exam, not prohibited from refilling exhisting prescriptions. You have been seen in the past 3 months - this is sufficient. He should check with his lawyer on the specifics of the law.
