I quit my job last year sept. I was having medical problems. My doctor was sending me for test and did not want me to go back to work after my visit with him. He gave me a note stating this. When I went to work the next day. I was advised my doctors note did not matter. The day was not excused and held against me. I was told if I had 2 more infractions that I would be terminated. I requested the day unpaid, but it still was held against me. My doctor had just started the process of sending me to a cardiologist for a stress test and I new I had upcoming dates I would not be working. I did not want to be fired, so I put in my 2 weeks notice. It was not until 03/06 that I was finally diagnosed with myasthenia gravis (neuromuscular disease). I don't think I have a case since I quit and did not wait for them to fire me, but I'm upset that they were not willing to work with me so I could keep my job and seek necessary medical help. Which turned out to be a very serious condition.

You may not have any legal recourse since you did quit but this would fall under the FMLA which is the Family Medical Leave Act which protects you and your job if you have to take time off due to illness or to care for an immediate family member that has fallen ill. It can also depend on how long you had worked for them before this happened but a doctor's note always has to be followed even if there is work allowed but restrictions. You can always get a free consultation with an attorney but this may not be able to be pursued due to the fact that you quit and they did not terminate you over the matter.

I could not use FMLA because I used it the year before when I had pnemonia. They said I could not use it again until I completed a certain amount of hours, which had not been completed when the symptoms started. I did advise my supervisior as well as her superior that I needed medical help, but since they were not willing to work with me I would quit instead of be terminated.
